REFUGEE CLAIM

Canada provides protection to individuals who face persecution, serious harm, or human rights violations in their home country. There are several pathways available depending on your situation.

In-Canada Refugee Claims (Inland Asylum)

Individuals already in Canada who fear returning to their home country may make a refugee claim, assessed by the Immigration and Refugee Board (IRB).

  • Submit a claim at a port of entry or inland IRCC office
  • Attend a Refugee Protection Division (RPD) hearing
  • If accepted: apply for permanent residence as a protected person
  • If refused: appeal to the Refugee Appeal Division (RAD) within 15 days, or seek judicial review at Federal Court

Note: Some individuals are ineligible, including those who arrived from the U.S. under the Safe Third Country Agreement (limited exceptions apply).

Government-Assisted Refugees (GAR)

Refugees identified abroad by UNHCR or a designated referral organization and resettled in Canada with government-funded support for up to one year. Selection is made by IRCC — individuals cannot apply directly.

How we can help: We assist GAR recipients in understanding their rights and navigating settlement services upon arrival.


Privately Sponsored Refugees (PSR)

Canadian citizens, PRs, and approved organizations can sponsor refugees abroad and commit to at least one year of financial and settlement support.

  • Sponsorship Agreement Holders (SAHs): organizations with formal IRCC sponsorship agreements
  • Group of Five (G5): five or more Canadian citizens or PRs who jointly sponsor a refugee
  • Refugees must be outside Canada and recognized as in need of protection
